Definitions

In this document, Guide to the Licensing World is synonymous with DJ Publishing Ltd.

You are defined as the user of the Licensing World online portal, and a corporate or business user

The Guide to the Licensing World online portal is the web based access point from which you can search our directory online

Our business hours are 9am - 5pm (M-F) UK time, with standard bank holidays, and the Christmas week closed.

Policy

This document is designed to help you be aware of how we operate, what you can expect from us, and what we require of you. Should you not wish to abide by these terms and conditions, please do not continue to purchase our services or products.

Our products/services relate to businesses only, and are generally not considered relevant for members of the general public. We will abide by UK laws where you are a business and we are the supplier. For example, although the Distance Selling Regulations do not apply to our transactions, we will endeavour to abide by them. This means:

1) You will be given clear information about the services we offer and you are buying

2) We will endeavour to deliver our paper based directory within 20 days however this depends on international postal services. We will endeavour to send the directory within 2 UK working days of our office opening hours

What are we offering?

We publish a directory called the Guide to the Licensing World listing contacts grouped by country, under the headings Licensors/Agents, Licensees and Specialist Services. The directory lists over 19000 properties and over 1500 Licensors/Agents.

Our online portal is the web based version of this directory where you can search using the same categories as within the directory and a few other categories. This however cannot be purchased singularly, but is purchased in conjunction with our published directory. The price we therefore charge for our product includes a copy of the printed directory. If you are already a subscriber of the published directory, then we offer a “bolt on” service where you can purchase online access for an additional cost.

Our directory is aimed at Licensees and Agents who may wish to contact each other regarding the licences they offer/use. Please be advised that should you purchase our directory, we will classify you as a business user for the intents and purposes of the Distance Selling Regulations.

Once payment has been processed online, you will receive an email giving you an activation code and password, and a link from which you can login and access our online portal. Should you wish to amend your password, you can do this from within the portal.

Terms of use

You are entitled to use, search and browse our online directory, through the websites provided in your registration email. Your username and password must be kept securely and you are prohibited from supplying this to anybody outside your office – including alternative offices in the same/ different countries. Our service will not let you login from an alternative country office.

The data we publish is there for your corporate/business use to promote further the services you offer. You will naturally wish to contact the businesses listed, however in doing so, you agree to abide by the following conditions:

1)       Any data you store electronically in a file (i.e. Excel, Word, Access) cannot exceed more than 100 listings/contacts or the entire scope of a country (i.e. the USA will have more than 100 entries). This data must not be distributed to any third parties, or other offices within your firm. It may however be used by different colleagues internally.

2)       You may contact the companies included in the Guide, however you must not

a.       Send explicit, profane, criminal material

b.       Send material outside the scope of licensing

c.       Contact the companies uninitiated more than once in any standard month

You must

a.       Include legitimate contact details within your contacts (i.e. sending from a legitimate email address)

b.       Include an opt out option in your email or published material from further contacts.

3)       We will from time to time “take down” the website to make upgrades and database updates. This means that for a short while you may not be able to access the online directory. When we do this it will either be a quick change (and therefore shouldn’t affect your browsing), or may be a bigger change and we will aim to state how long the service will be down.

4)       If the website appears to be down, it may be due to technical issues outside our control due to the site being hosted in the US. If this happens, please email support@licensingworld.co.uk and we will then endeavour to get the website back up and running as quickly as possible.

5)       We reserve the right to withdraw the online service at any given point, however we will notify you of this and give a reasonable notice period.

Please note that these points enable us to comply with UK/EU legislation. However you are required to oblige by them as well under these Terms and Conditions.

Security

We consider your security very important whilst visiting our site and purchasing any services we offer.

As such the following security measures are in place:

1) SSL Encryption
Pages where you submit credit card/payment details will be SSL encrypted pages, hosted by our internet merchant service (Protx).

2) Use of Cookies
Cookies are small files which store information about you as you travel between different pages on a website. They do not usually slow your PC down or cause any issues. We use “session cookies” which mean they expire (or die) when you close your web browser. This is generally considered better than storing them somewhere specifically on your PC as they cannot be read by malicious scripts. To clear the cookies our website creates, simply close your internet browser when you have finished purchasing our services.

3) Inactive logout
If you do not use our service for a period of time you will be logged out and will need to login again.

4) Password storage
We store your passwords in our database using strong encryption. This means that we cannot tell you what your password is if you forget it, as there is no way to actually decrypt it. If you forget your password there is a page where you can enter the email address you submitted and we will send you a new password. The encryption is not a problem if you forget your password, its just there to secure it whilst its being stored on our servers.

Data & Privacy

We will store information about you on our database systems, when we take your payment and registration details. This will not include your credit card details as these will be stored by our internet merchant service (Protx). We will however store information they supply us about your order.

We will store the country you login from at the point of signing up to our service. You will only be able to login from that country using the given username and password. If you need to be able to access your account in a different country, then please contact us. We reserve the right to charge for enabling this service.

We reserve the right to store how many times you access your account and the search phrases you use. This is purely for information on general usage and what people are actively searching for.

You agree that all data supplied to us is correct as we will send you a copy of the published directory (unless you already receive a copy). We retain the right to do a credit card check against the address you supply when you pay for our services.

Once you start to enter private data, you will be using an SSL secure encrypted website, which means that your data is transacted securely. At any point where your data is visible (i.e. to amend your contact details) it will be through our SSL portal (https://secure.licensingworld.co.uk).

Should you wish to amend any details you can do this through the Guide to the Licensing World online portal.

None of your personal data will be given to any third parties. However, we may introduce directory updating from the online portal, and should you be listed within our directory, the personal data you submit specifically for use in the directory will be made available in our directory. This will however remain separate from the data you use to create/pay for our services.

Contacting you

We will from time to time contact you through the email address you supply. Under our obligations we will supply you with correct contact details, and the address we send from can also be used to request opting out of our email list.

We will not however supply your personal contact details to third parties. As within the section titled Data & Privacy, we may supply official contact details should there become a link from the Guide to the Licensing World Online portal to an update facility, if you are currently listed in the directory.

Delivery

As listed under the section titled Policy,

“We will endeavour to deliver our paper based directory within 20 days however this depends on international postal services. We will endeavour to send the directory within 2 UK working days of our office opening hours”

Should goods not arrive with you within 30 days, please contact us so we can chase up why they have not arrived. As mentioned, international delivery is restricted to the service provided by our international couriers and we will endeavour to use those with a good delivery record.

Payment

As mentioned, all payment information will be collected on our SSL encrypted website. From here it will be submitted to our online provider for processing. We only accept payment by credit or debit card, and the most regular cards are accepted. Should you receive any errors during the processing of your payment, please contact us on +44 1892 668444 during our regular office hours. We will investigate the payment status, and take an alternative payment method over the phone if that is suitable.

Should you wish to pay over the phone rather than through our website, then please contact us at the above number. Your account setup will not be instantaneous, but will be created as quickly as possible. For an automatic account creation, please use our website.

Refunds/ Returns

We hope you are happy with your purchase from us. If however our products arrive to you in an unsatisfactory condition please contact us to discuss returning/ replacing them.

It is our policy that we do not offer a refund once the book and/or online access has been purchased.

Tax/VAT

If you are in an EU member country, we are required to log your EC company tax number and as such will ask for this when you signup. It is not a compulsory field, but we will need this from you at some point in the future.

Currently neither our published directory or web based version are liable for VAT.

Copyright

All data displayed in the directory and on the website remains the property of the Guide to the Licensing World (DJ Publishing Ltd) and may not be copied unless used within the parameters of these Terms & Conditions.

Any adverts or images listed in our directory, or on our online portal cannot be reproduced or ordered from us for use in other publications. You should seek the permission of the relevant party.

We will not list a logo or trademark unless you are the legal owner of the image or logo, or have permission from the legal owner to display this logo.

Whilst we have made every effort to validate the entries we submit, we will not be held liable for any inaccuracies that may occur.
